HELP and Other Study Loan Obligations for Australians Living Overseas
Overview
Moving overseas does not extinguish an Australian study-loan balance and can create annual worldwide-income reporting obligations.
Australians and former Australian residents with HELP, VET Student Loans, Australian Apprenticeship Support Loans and certain other study or training debts can have obligations while living overseas. These obligations are separate from ordinary tax residency.
A person may need to notify the ATO of an overseas move, report worldwide income and make a compulsory overseas levy even if they are a foreign resident and have little or no Australian assessable income.
Notification and annual reporting
Individuals generally need to update contact details and notify the ATO when moving overseas for the relevant period. They may then need to lodge an Australian return or an overseas levy form, depending on whether they have Australian income and other obligations.
The ATO publishes annual overseas income and repayment thresholds. The exact threshold and calculation method must be checked for the year because reforms can change both.
Worldwide income and repayment income
Overseas reporting is based on worldwide income concepts rather than only taxable Australian income. The calculation can include foreign employment, business, investment and other amounts, translated into Australian dollars under the prescribed method.
Allowable deductions and adjusted taxable-income components may differ from the foreign country’s taxable-income calculation. A foreign tax return figure should not be copied without reconciliation.
Foreign residents with Australian income
A foreign resident with Australian rental or employment income may need a full Australian tax return as well as worldwide-income information for study-loan purposes. The return can therefore contain both Australian taxable income and additional repayment-income data.
Paying tax overseas does not itself discharge the Australian study debt. Foreign tax credits address double taxation, not loan repayment obligations.
Voluntary repayments
Voluntary payments can reduce the balance but generally do not replace a compulsory amount arising for the year. Indexation and repayment rules should be reviewed before making assumptions about timing or benefit.
